Is it fair to prosecute people for NOT doing something?


The law on omissions is controversal. How fair is it that someone can be liable for an offence due to a failure to act?

  1. A person should be free to do what they want.
    Even if it is morally wrong, they should be able to choose.

  2. Everyone has a responsibility to one another. If you volunteer to help someone, regardless of your intentions, it is your neck on the line, and you put it there by your own choice. If something goes wrong, you have no-one to blame but yourself.
